LEGISLATION AND COMPETENCES
The Government Decision no. 752/2004 - on the equipment and protective systems intended for use in areas with hazards of explosive atmospheres. The Government Decision no. 119/2004 on the safety of machines and the Government Decision no. 115/2004 on the industrial protection equipment which cover the essential health and safety requirements and the moduli of the new approach to assess compliance stipulated at European level by the Directive 94/9/EC (ATEx), the Directive 98/37/EC (Machinery) and the Directive 89/686/EC (PPE).
These directives have been implemented into the Romanian legislation and they form the basis of operation for the department for the certification of technical equipment and of the personal protection equipment intended for use in potential explosive atmosphere (Ex) and in the extractive industry. This department is at INSEMEX and its abbreviation is SECEEx. It is recognized by the national authority involved in the observance of the procedures of assessment of compliance in this field of regulation.
The assessment of compliance is one of the tools used to provide the safety level necessary for the producers, beneficiaries and the authorities with responsabilities in the field of regulation.
INSEMEX - SECEEx is organized and operates according to the European norm EN 45011 and includes a testing laboratory organized in compliance with the stipulations in the European norm EN ISO 17025: INSEMEX - LIEx.

COMPETENCES
a) Technical equipment:
- intended for use in Ex areas, according to the Government Decision no. 752/2004 (the implementation of the Directive ATEx 94/9/EC);
- intended for use in the extractive industry, according to the Government Decision no. 119/2004 (the implementation of the Directive Machinery 98/37/EC);
b) Personal protection equipment intended for use in areas with hazard of explosive and/or toxic atmospheres, according to the Government Decision no. 115/2004 (the implementation of the Directive PPE 89/686/EC).
